What Is Work Permit Cancellation and When Is It Needed?

Work permit cancellation is a formal procedure. It removes the legal right of a foreign national to work in Ukraine. You must cancel a work permit if the job ends earlier than planned. It doesn’t happen automatically. Although the employment may have ended, the permit remains officially active until it is formally cancelled. Authorities require compliance with the cancellation process. Otherwise, a worker, entrepreneur, or company will face legal issues. The procedure applies to temporary and long-term permits.

When Is Work Permit Cancellation Required?

The most common cases:

  • You resign or get fired.
  • The company is liquidated or reorganized.
  • Your employment contract is terminated early.
  • You switch jobs and need a new permit.
  • You leave Ukraine.

The law obliges the worker or the employer to initiate the process. Often, it’s the employer who must submit the application. If neither party acts, the permit remains active. This creates complications for future work permit applications.

Cancellation is also required if the State Migration Service rejects your stay extension or residence permit based on employment.

The process of work permit cancellation is regulated by Ukrainian labor and migration law. The key rules are defined by:

  • The Cabinet of Ministers Resolution No. 437;
  • The Law of Ukraine “On Employment of the Population”;
  • Orders from the Ministry of Economy.

Only the employer can submit the cancellation request. The company can use legal representation. A foreign worker can’t cancel the permit directly unless authorized by a power of attorney. Documents must be received within 10 days.

Required Documents for Work Permit Cancellation

The list of required documents may vary slightly based on the situation. Still, two standard sets exist. One for general cases, and another to terminate a work permit early.

  • Application form to cancel a work permit, signed by the employer;
  • The company’s official termination order;
  • Copy of the foreigner’s passport;
  • Company registration documents (EDRPOU code or extract);

Some local authorities may request an explanation letter. It's optional but helps avoid delays.

    Await the Decision

    Once submitted, the authorities will review the case and update the register. Usually, the cancellation is processed within 7–10 working days. You don’t get a physical certificate — the permit is marked as “revoked” in the employment register.

    If there are issues like missing documents, unclear dates, or conflict between parties, processing may pause. The authority will notify you or request clarification.

    It’s important to follow up if you don’t receive feedback within two weeks.

Typical Timeframes and Official Fees

Processing a work permit cancellation takes 7 to 10 working days. There is no official state fee for cancellation. However, if translations, notarization, or courier services are needed, they are paid separately. If you need to cancel urgently or from abroad, additional time may be required to prepare a proper application via power of attorney.

For employers, failing to terminate a work permit on time may trigger inspections or administrative fines. Even if the foreigner has already left Ukraine.
