Overview

The immigration quota in Ukraine is one of the least understood, and most underestimated mechanisms for obtaining permanent residence permit. In Ukrainian law, a foreigner can obtain an immigration permit either on quota or non-quota grounds.

Both options exist on paper. In practice, quota-based immigration causes the most confusion. Especially for foreign investors and highly qualified specialists.

Quota vs Non-Quota Immigration: What Is the Difference?

Foreigners can immigrate to Ukraine by obtaining an immigration permit on both quota and non-quota grounds. Ukraine has 11 legal non-quota grounds for immigration permits.Not all 11 grounds are popular. Below are the ones we actually work with most often.

Five years of legal residence

Foreigners who have continuously lived in Ukraine for 5 years on a temporary residence permit. Without any long breaks, overstays, or invalid permits may reset the count. This is checked very strictly.

The main rule is to reside in Ukraine for at least 180 days during the year and not to leave for more than 90 days at a time.

Business trips, trips for treatment, study, or other important needs are not taken into account, but this will need to be proven to the migration service, so everything must be clearly documented.

Military service with health consequences

Persons who served in armed Forces of Ukraine, National Guard, State Special Transport Service and were recognized by a military medical commission as unfit for service due to injuries or illnesses received during service.

Three or more years of military service

Separate ground, often confused with the previous one. Here the key factor is length of service, not health condition.

Family members of an immigrant

This includes: spouse (marriage over 2 years), children under 18, disabled parents

Nuance from practice: Marriage certificates are always cross-checked for “formal marriages”. Interviews happen.

Foreign investors (USD 100,000+)

One of the clearest quota grounds.

Requirements:

  • foreign convertible currency;
  • minimum USD 100,000;
  • investment into the Ukrainian economy.

This ground is often combined with company registration. Registration is the very first and most important stage in this case. A large part of the success in this process depends on the correct preparation of documents at this stage.

Highly qualified specialists

This is currently the fastest-growing category.

Especially for IT specialists, engineers, technical experts and R&D professionals. We now see many cases where specialists later open businesses or relocate teams.

This is not accidental. Ukraine is becoming an IT and technology hub, even during the war. Foreign specialists see real opportunities here.

From practice, the requirements are surprisingly moderate.

Typical requirements for IT specialists:

  • annual income: from USD 24,000;
  • work experience: usually 3 years, within the last 5 or 7 years (depends on role).

Compared to other countries, this is very accessible. For doctors or regulated professions, additional diplomas and certificates are required — but even then the system is not overly restrictive.

How Immigration Quotas Are Approved Each Year

This part is critical. Immigration quotas in Ukraine are:

  • approved once per year;
  • divided by regions;
  • divided by categories;
  • based on economic importance.

In simple terms: Ukraine decides who it needs most — and gives them more quota places.

The quotas are approved by the Ministry of Economy at the beginning of each year. Before you even apply for an immigration permit, you must confirm that you fit the quota category.

  • Most categories → Ministry of Economy;
  • IT specialists → Ministry of Digital Transformation.

This step is often skipped or misunderstood — and that causes delays.

Requirements: Lower Than Most Expect

One of the biggest misconceptions is that quota immigration is “hard”. Immigration policy in Ukraine is not as developed as in other European countries, for example, in the USA or Great Britain. Quite often, foreigners who wish to immigrate to Ukraine face difficulties in finding a basis for such immigration. But every person in life works somewhere, right?

Therefore, we have considerable experience in immigration for highly qualified workers. Due to the fact that the requirements for the relevant positions are in most cases quite simple, finding one that is suitable for any foreigners is not difficult.

In reality, for many applicants it is enough to meet:

  • 2–3 key criteria;
  • with clear documentation;
  • and correct timing.

This is one of the reasons we actively recommend this route to eligible clients.

Common Mistakes We See

Although we constantly repeat in this article about the relatively simple requirements and the simplicity of the process, this is not always the case, especially when foreigners want to go through this process on their own.

In our experience, foreigners who independently tried to immigrate to Ukraine on this basis were refused 99% of the time at the stage of approving qualifications at the Ministry of Economy or the Ministry of Digital Transformation (in the case of IT specialists).

This process looks simple, first of all, if you enlist the qualified support of immigration lawyers who have already gone through this path dozens and hundreds of times with clients.

Short list, but important:

  • wrong quota category
  • late submission (quota already closed)
  • incorrect ministry
  • incomplete income confirmation
  • incorrectly legalized documents

Most of these mistakes do not cause refusals — they cause lost time.

Very often, foreigners submit a request at the end of the year, which is also a mistake, because even if your qualification is successfully approved at the end of the year, you may simply not have time to submit all the documents to the migration service.

Because, as we said at the beginning of this article, the quota is approved every year, and if you do not have time to submit in the year in which you are approved, you will have to resubmit the request because there will already be a new order on new quotas.

Conclusion

The immigration quota in Ukraine is a practical and functioning mechanism for obtaining an immigration permit and permanent residence, but it requires proper planning. Most difficulties arise not from the law itself, but from incorrect timing, the wrong quota category, or poorly prepared documents.

For foreign investors and highly qualified specialists, quota-based immigration often remains one of the most realistic pathways to permanent residence in Ukraine. When eligibility is assessed in advance and documents are submitted at the right time, the process is far more predictable than many expect.
